Warren v. District of Columbia, 444 A.2d 1 (D.C. Ct. of Ap., 1981).

When the State takes a person into its custody and holds him there [489 U.S. 189, 200]   against his will, the Constitution imposes upon it a corresponding duty to assume some responsibility for his safety and general well-being.

Constitutional duties of care and protection only exist as to certain individuals, such as incarcerated prisoners, involuntarily committed mental patients and others restrained against their will and therefore unable to protect themselves.

LOL You getting me all excited over here! I plan to go and give myself an orientation session & get myself acquainted with the law library tomorrow or Sunday afternoon for about 4-5 hours. Should be interesting.

This is true! It only pertains to PUBLIC making the protection for the general public. Key word is PUBLIC because tax dollars goes towards PUBLIC SAFETY and not individual safety.

As Common said: It's the words!!!!!

Thanks for the law drop.  I was just talking about the police with a few classmates of mine.  I was telling them that the police are there to collect "taxes" and that there's no way that they can possibly protect everybody.  On Chicago PD and most police cars it has the words "Protect and Serve" but never says anything about what they are protecting and who they are serving.

LOL! I be getting excited too! Everytime I read the rulings, I be like, goddamn! I always hear about how the government is corrupt, but this shit is in stone.

I love studying law too!

@El Negro:  It is amazing how it is in black and white for all to see.  We just never take the time to look.

opps! tried to do the highlighting thing and didn't know how. XD  Guess I still like the purple font...lol
